1. Who is responsible for processing your data?
The data controller is “FERMAX ELECTRÓNICA, S.A.U.”, with its registered office at Avenida Tres Cruces, 133, 46017 Valencia (Spain), and Tax Identification Number A-46.036.554 (hereinafter, “FERMAX”).

2. What categories of personal data will FERMAX process?
When using the FERMAX DuoxMe application (hereinafter, the “Application”), we will process various types of personal data relating to the customer and/or user, which fall, as applicable, within one of the categories set out below:
- Identifying data: IP address and user name.
- Contact details: Email address and postal address.
- Identifying data: Images.
3. Why, and on what legal basis, does FERMAX process your personal data?
At FERMAX, we will process your data for the following purposes and, in each case, in accordance with the legal bases set out below:
a) Registration on the App
FERMAX will process the personal data you provide via the registration form provided for this purpose within the App to manage your registration, create your profile within the App and enable your access to FERMAX’s digital service (hereinafter, the “Digital Service”).
The processing of the data you provide via this form is necessary to grant you access to the App through which you will use the Digital Service. For this purpose, we will process your contact details. The legal basis for this processing is the performance of the contractual relationship, as well as your consent.
b) Provision of the Digital Service to the user
FERMAX will process your personal data as a registered user so that you can use the Digital Service and gain access to the various features (depending on the building’s terminal and/or the User’s service plan) via the App (e.g. digital opening of communal doors, call forwarding to the video intercom, etc.).
In addition, you will receive notifications via the App informing you of any changes that may affect your profile (e.g. when you are invited to use the Digital Service in a property, notified of new versions of the App available, or provided with any other relevant information regarding the use of the Digital Service), and you may change your login password, if you wish, via the section provided for this purpose in the App.
This processing is necessary for the proper performance of the contractual relationship. For this purpose, we will process your contact details.
Similarly, if you meet the requirements to use the “automatic image capture” or “photocaller” feature, you will be able to view, via the activity log in the App, the calls you receive via the video door entry system, including, amongst other data, a photograph of the person who called your home at that time, which could be of a third party or of yourself if you are the one calling your own home.
This photograph is taken via the door station camera every time your home is called and is stored on FERMAX’s servers for a maximum of one (1) month so that you can view it via the App. Once this period has elapsed, the captured images will be automatically deleted and cannot be viewed in accordance with the provisions of Organic Law 3/2018 of 5 December on the Protection of Personal Data. FERMAX processes the stored images solely for the purpose of retaining them for the legally established period.
For this purpose, we will process identifying data. The legal basis for such processing is the performance of the contractual relationship, as well as your consent.
c) Registration of new members
Users registered in the App with the role of “main user” or “administrator” (identified in the App with the label “Owner”) for a specific property must be of legal age and may invite new members as “guest users” of that property to use the App by entering the email addresses of such third parties.
Once entered, FERMAX will send the guest users an email through which these third parties may register as new members of the property to which the main user has invited them, so that they may use the Digital Service.
This processing is carried out with the consent of the guest user. For this purpose, we will process the guest user’s email address provided by the main user. The legal basis for this processing is the performance of the contractual relationship, as well as the consent of the main user.
When providing us with personal data of third parties (invited users or new members), you must do so with their consent — and if they are minors, with the consent of their parents or guardians — and have informed them in advance of the matters contained in this Privacy Policy so that they are aware of the use of their personal data by FERMAX.
d) Compliance with legal obligations
FERMAX may process your data to comply with the various legal obligations applicable at any given time, including the handling of data protection rights.
In addition, if requested by any court or tribunal, the State Security Forces, or any other competent public authority or administration, we may also be required to provide your personal data, as we are legally obliged to do so.
For this purpose, we will process your contact and identification details. The legal basis for such processing is compliance with a legal obligation.
e) Receipt of prizes linked to commercial promotions and management of commercial communications
FERMAX may process the personal data provided by users during the registration process on the App, or via the forms provided for this purpose, in order to manage their participation in any current commercial promotions, prize draws or similar initiatives, as well as to enable users to receive the prizes associated with such promotions.
Furthermore, FERMAX may process the personal data that the user voluntarily provides in order to receive marketing communications relating to FERMAX products, services or news. In each promotion or marketing communication, the user will be informed of their rights regarding the protection of personal data and of the possibility of withdrawing their consent at any time.
4. How long will we keep your data?
The personal data to which FERMAX has access will be processed for as long as the purpose for which it was provided remains valid. In any event, will ensure that your personal data is properly blocked once it is no longer required. In accordance with legal provisions, we will retain it only (i) for the periods determined in each case by the applicable regulations, and (ii) for the limitation period of any claims that may arise from the relationship with the data subject.
Once these periods have elapsed, we will proceed to permanently delete the data.
5. How do we obtain the data processed in the Application?
The data processed by FERMAX is obtained in the following ways
- Data obtained from the data subject themselves: you provide this directly and voluntarily when registering on the App, using the Digital Service or during the course of your relationship with FERMAX.
- Data obtained via the main user or monitor administrator: information about other users provided to us by the main user, having previously informed them of the processing of personal data to be carried out by FERMAX, as well as having obtained the necessary consent for such processing to take place.
6. To whom will your data be disclosed?
FERMAX ELECTRÓNICA, S.A.U. is the data controller responsible for processing your personal data. However, unless prohibited by current legislation, other companies may have access to your personal data when providing services to FERMAX as data processors to fulfil the purposes described in this Privacy Policy. Both the data controller and the data processors will determine the appropriate technical and organisational measures to be implemented in order to ensure and demonstrate that the processing complies with the law, its implementing regulations and applicable sector-specific legislation. Furthermore, on certain occasions, your personal data may be disclosed to third parties to whom we are legally obliged to provide it, such as public bodies and authorities, the Tax Agency, the courts and tribunals, or the State security forces.
Likewise, should users decide to participate in the current promotions detailed in the Terms and Conditions of Use of the Application, FERMAX may share with the third parties responsible for delivering the relevant prizes, in each case, the personal data necessary for the user to receive said reward.
7. Do you need to keep your data up to date?
In accordance with applicable regulations and in general, you must be the data subject of the data you provide to us for our databases, and such data must be correct, complete, accurate and duly up to date.
However, should you, in your capacity as the main user or administrator of the monitor, provide us with the personal data of other users, please note that you must do so with their consent and must have informed those users in advance of the provisions contained in this Privacy Policy so that they are aware of the use of their personal data by FERMAX.
If any of the personal data you have provided to us changes, particularly your postal address or email address, you must notify us as soon as possible so that we can update our databases.
Otherwise, if you do not inform us of these changes, any communications we have sent to the email address on record in our internal systems will remain valid.
8. Cookies
Users are informed that the cookies (or similar storage technologies) used by FERMAX in the Application (hereinafter, the “Cookies”) are subject to the exception set out in Article 22.2 of Law 34/2002 of 11 July on Information Society Services and Electronic Commerce; consequently, it is not necessary to obtain the user’s consent for their use. Specifically, the purposes of the Cookies used in the Application are: (i) to enable communication between the Application and FERMAX’s servers; (ii) to provide the Digital Service expressly requested by the user; (iii) to authenticate or identify the user in order to log in to and maintain a session with the Digital Service; (v) to ensure the user’s security whilst using the Digital Service; (vi) to personalise the Application’s interface; (viii) to analyse, anonymously, users’ use of the Application in order to improve the Digital Service.
9. What are your rights when you provide us with your data?
You have the right to access, rectify, object to, erase, restrict the processing of, and transfer your personal data, and to withdraw your consent at any time, freely and easily, by sending an email to support.duoxme@fermax.com from the same email address used to register on the App.
Similarly, you may raise queries regarding your personal data by sending an email to privacidad@fermax.com or from the same email address used to register on the App.
Finally, you may lodge a complaint at any time with the Spanish Data Protection Agency via the website https://www.aepd.es, particularly if you have not received a satisfactory response regarding the exercise of your rights by writing to privacidad@fermax.com
