General conditions of use of the website
The terms and conditions indicated below regulate access to and use of the website MyConnect (hereinafter, the "site" or "website") and its sub-domains, a website under the responsibility of Fermax. The expression "site or website" includes, but is not limited to, the texts, graphics, images, animations, musical creations, videos, sounds, drawings, photographs, etc. included therein, and, in general, all creations expressed by any means or support, tangible or intangible, currently known or to be invented in the future, regardless of whether or not they are subject to intellectual property in accordance with the Revised Text of the Intellectual Property Law or any future regulation that may succeed it.
Accessing and registering on the website implies that the user acquires a series of rights and obligations, with the aim of guaranteeing the proper enjoyment of the services and contents found on the website and which Fermax makes available to the website user free of charge.
The user is aware that access to and use of the contents, services and functionalities of the website, as well as the provision of the services which, through the same, may be provided to end customers of Fermax products, is carried out under their sole and exclusive responsibility.
Consequently, the user undertakes to make correct and lawful use of the site, in accordance with the applicable law, these Terms of Use, good faith and public order. The user shall be liable to Fermax and/or third parties for any damages that may be caused as a result of non-compliance with this obligation. Consequently, Fermax shall under no circumstances be liable for the inappropriate use that the user may make of the website, of the services that may be provided to third parties or of the damages that the misuse of the same may cause to third parties.
The website is a tool that Fermax makes available to users for the development of their economic activity. User status is acquired by accessing and registering on the website. The user will use the services and contents of the website exclusively to carry out the services that correspond to him/her as an installer of Fermax products.
Fermax informs users of the following general conditions of use, which are expressly and fully accepted by them by the mere fact of accessing and registering on the website, as well as by the use of the contents of the site and the provision of the services that may be developed through it.
Should these general conditions be replaced by others, in whole or in part, these new general conditions shall be deemed to be accepted in the same way as those set out above. Nevertheless, the user of the website must access these general conditions periodically to know the successive versions that are included here, although it is recommended that the user accesses them each time he/she intends to access or make use of the services and contents of the website.
Fermax may establish specific conditions for the use of certain contents and services, which must be known and accepted by the user prior to use in their accordance with the terms set out in said specific conditions.
In the event that the user does not accept these general conditions or, where applicable, the specific conditions governing the use of a particular service and/or content, the user must refrain from accessing the website.
The user must establish the appropriate technical security measures to prevent undesired actions on their information system, files and computer equipment used to access the Internet and, in particular, the website, being aware that the Internet is not totally secure.
Purpose of the website
By accessing the site, the user will be able to, among others:
- View a summary of the installations carried out with the most representative metrics: total number, type and number of devices installed, locations and connection status.
- Register the postal address of the installations carried out in order to have them inventoried and geolocated on a map;
- List the installations and export the data of your installations in a CSV file;
- Access each installation to check the devices installed and their detection and connection status, as well as the values of the settings configured for each of them.
- Benefit from automatic firmware updates on the connected installations carried out periodically by Fermax technical staff.
- Label the homes with the number or name of the flat or resident.
- Replace faulty amplifiers, keeping the information registered in the installation.
- View the warranty status of the installation and devices*.
- Remotely manage the agenda and access control information of the panels ** (exclusively for CORA CONNECT model panels).
- Remotely intervene to modify the settings (timer and audio) or check the operation of the audio and video amplifier of the connected installations registered with your user account.
- Send suggestions to Fermax for improving the functioning of the portal.
*The information on product warranties shown on the portal is informative and does not replace the commercial warranty based on the date of your purchase invoice. If in doubt, please contact your FERMAX supplier.
**In the event of handling personal data to include information relating to residents in the outdoor panel agenda and for this to be displayed on the panel display, the authorised installer is responsible for the collecting and processing of this data and must have the express authorisation of the community for this purpose.
In general, the content of the website will be available in Spanish, Portuguese and Polish, as well as in any other language spoken in the European Union that Fermax may progressively consider.
Fermax may unilaterally modify, without prior notice, the presentation, configuration, content and services that may be offered through the site, as well as the conditions of use of itself and of access to the services that may be provided through it.
The cost of telephone consumption or any other type of expense for connection to access the website shall be borne exclusively by the user. The user must only meet the following technical conditions in order to register and benefit from the use of the website MyConnect:

User rights and obligations
The user will be able to:
To access the contents and services of the site free of charge and without the need for prior authorisation, without prejudice to the need for prior registration of the user in order to access the contents of the website.
Use the content of the site for the development of your professional activity in your capacity as installer of Fermax products.
In any case, the user must make correct and lawful use of the site, as well as of the services that may be provided through it, in accordance with current legislation, morality, good customs and public order.
Special reference to the remote intervention service on connected installations.
The user may also carry out remote interventions to modify certain configuration parameters of the outdoor panels of the connected installations, provided that said interventions are aimed at resolving incidents previously reported by the administrator or representative thereof.
The user is also informed that this type of intervention may imply the temporary interruption of the operation of the video door entry system of the connected installation during the course of the intervention, and Fermax accepts no responsibility for this fact.
Access to and use of the MyConnect portal for these purposes implies the user's commitment to act in accordance with current legislation on data protection and good professional practices , limiting the intervention exclusively to the resolution of the reported incident".
Prohibitions
Under no circumstances may the user:
Accessing or using the services and contents of the site for illicit purposes that are harmful to the rights and freedoms of third parties, or that may harm, damage or impede access to the same in any way, to the detriment of Fermax or third parties.
Use the website or the services that may be offered through it, in whole or in part, to promote, sell, contract, disseminate advertising or information of their own or of third parties without prior authorisation from Fermax.
Entering information on the website or using the services that may be offered through the same, with the aim of directly or indirectly infringing the rights and, in particular, the fundamental rights and public liberties of other users of the Fermax website and/or its end customers; inciting or promoting criminal, xenophobic, terrorist or degrading acts on the grounds of age, sex, religion or beliefs; or of a pornographic, obscene or violent nature or that infringe the law, morality or good customs.
Use the services and content offered through the site in a manner contrary to the general conditions of use and/or the specific conditions that regulate the use of a specific service and/or content, and to the detriment or detriment of the rights of other users.
Take any action that prevents or hinders access to the site by users.

Create frames within a website that you are responsible for or own that reproduce the home page of the website and/or the pages accessible through it, without the prior authorisation of Fermax.
Include a hyperlink on a website under its responsibility or ownership that generates a window or session of the browser software used by a visitor, user or client of its website, which includes trademarks, trade names or distinctive signs of its ownership and through which the main web page of is displayed MyConnect or any of the pages accessible through it .
Use the brand, commercial names, as well as any other identifying sign that is subject to the intellectual or industrial property rights of Fermax, without the express prior written authorisation of Fermax.
Carry out any action that involves the reproduction, distribution, copying, rental, public communication, transformation or any other similar action that involves the modification or alteration of all or part of the contents and services of the site or the economic exploitation of the same, without the prior written authorisation of Fermax, or of the third party owner of the intellectual and industrial property rights that apply to the services or contents of the website.
Rights and obligations of Fermax
Fermax reserves the following rights:
Modify the conditions of access to the site, technical or otherwise, unilaterally and without prior notice to users, without prejudice to the provisions of the specific conditions governing the use of a particular service and/or content.
Establish specific conditions and, where appropriate, the demand for a price or other requirements for access to certain services and/or contents of the website.

Fermax disclaimer and limitation of liability
Fermax shall not be liable for damages of any kind in the following cases:
Due to the impossibility or difficulty of connection to the communications network through which this website is accessible, regardless of the type of connection used by the user.
For the interruption, suspension or cancellation of access to the website, as well as for the availability and continuity of the operation of the website or of the services and/or contents therein, when this is due to a cause beyond the scope of control of Fermax, whether directly or indirectly caused by the latter.

At no time shall Fermax assume responsibility for any damages that may be caused by the information, contents, products and services to which users have access through the website, nor for the services that said users may provide to third parties through the aforementioned website.

If the culpable or negligent action or omission directly or indirectly attributable to the user of the website that gives rise to the infringement of the intellectual and industrial property rights of or of third parties -whether or not there is any benefit for the user- causes Fermax damages, losses, joint and several obligations, expenses of any nature whatsoever, sanctions, coercive measures, fines and other amounts arising or deriving from any claim, demand, action, lawsuit or procedure, whether civil, criminal or administrative, Fermax shall be entitled to take action against the user by all legal means at its disposal and claim any compensation amounts, including, but not limited to, moral damages and image, consequential damages and loss of profit, advertising costs or any other type of costs that may result for their reparation, amounts of penalties or convictions, interest for late payment, the cost of financing both amounts that may result for the opposing party, the legal costs and the amount of the defence in any proceedings in which it may be sued for the aforementioned causes, for the damages caused by reason of its actions or omissions, without prejudice to exercising any other actions to which it is entitled by law.

Duration

Full agreement

Invalidity and voidability

Competent law and jurisdiction

Fermax wishes to inform users of the website of its policy regarding the processing and protection of personal data collected from users when viewing the site, registering and using the services offered therein.

In addition to the above, with the user's consent, their data may also be transferred to companies in the Fermax group for commercial purposes.

The controller shall take measures to ensure that any person acting under its authority who has access to personal data may process such data only on instructions from the controller, unless obliged to do so by Union or Member State law.
The Controller informs users that, taking into account the state of the art, the costs of implementation, and the nature, scope, context and purposes of the processing, as well as risks of varying likelihood and severity to the rights and freedoms of natural persons, the Controller and, where appropriate, the processor shall implement appropriate technical and organisational measures to ensure a level of security appropriate to the risk.
Data quality

Exercise of rights
The Data Controller informs you that users may exercise their rights of access, rectification, cancellation, opposition, limitation of data processing and data portability by any of the following means:

Fermax informs users that the exercise of these rights is very personal, and therefore only the user may exercise these rights with respect to the personal data of which he/she is the legitimate owner. Nevertheless, and in the cases in which it is exceptionally permitted, the authorised representative of the user may exercise the rights to which he/she is entitled under the terms set out above, provided that he/she accompanies the aforementioned communication with the document accrediting such representation.
Fermax informs that the exercise of the aforementioned rights by a third party not legally authorised by the user could constitute the commission of the crime of discovery and disclosure of secrets provided for in the second section of article 197 of the Penal Code, punishable by a prison sentence of one to four years and a fine of twelve to twenty-four months; without prejudice to any other consequences that may be incurred as a result of any civil or administrative actions to which both the legitimate user who is the owner of the personal data and Fermax may be entitled.
Preservation times
The personal identification data is kept for as long as the user remains registered as an official Fermax installer and has not expressly requested the cancellation and deletion of their data, and always for the minimum period required by law.
The data collected shall be deleted when they are no longer necessary or relevant for the purpose for which they were collected or recorded. In the event that the data collected is intended to be used for a purpose other than that for which it was collected, the prior consent of the data subjects shall be required.
Recommendations to users
Fermax recommends that users use the latest versions of the software, given the incorporation of greater security measures.
Likewise, Fermax recommends that users use the security mechanisms available to them (secure web servers, cryptography, digital signature, firewall, etc.) to protect the confidentiality and integrity of their data to the extent necessary, given that there are risks of impersonation or violation of communication.
Fermax reminds users that the Internet is not always as secure as we would like it to be, so they should adopt the necessary and appropriate technical measures to prevent unauthorised processing of their data.
Fermax warns users that whenever they provide personal information over the Internet via e-mail, newsgroups, discussion forums, etc., they should be aware that such information may be collected and processed for purposes not desired by users. Fermax therefore recommends that users inform themselves about the confidentiality and privacy policies of the online sites they visit.

This Privacy Policy may need to be updated, therefore, it is necessary that you review this policy periodically and if possible each time you access the website in order to be properly informed about the type of information collected and its treatment.
