Privacy Policy
FERMAX ELECTRONICA S.A.U. (hereinafter FERMAX) informs its users and clients of the policy carried out with regard to the treatment of all personal data which, through the use of its products and services, are provided to it as the Person Responsible for the Treatment. Doing so will fulfil the Organic Law 15/1999 of Protection of Information of Personal Character (hereinafter LOPD), and of the Royal Decree 5/2018 by which this law adapts to the REGULATION (UE) 2016/679 (hereinafter GDPR or General Data Protection Regulation).
FERMAX recognises privacy as a fundamental right of all its users and customers, and has implemented all reasonable measures to ensure the security and protection of personal data of our customers worldwide. As an international organisation, with legal entities, management structures and technical systems spread around the world, we strive to implement rigorous security policies and procedures that offer a degree of protection for our users that often exceeds the legally required minimums.
This privacy statement informs users about the practices implemented by FERMAX to guarantee the transparency of access to each user's own information, as well as to inform them of the options available to them to exercise their right to access, rectify and delete their personal data, limit processing and portability. These rights also apply to information that may be obtained from the operation and use of our devices, and the services associated with them, including those offered by our customer service department.
This privacy statement applies to all products and services offered by Fermax, including websites, web and mobile applications, and subscription services offered by FERMAX and any of its affiliates and group companies (collectively, "FERMAX Services").
WHAT DATA DO WE COLLECT?
FERMAX only collects, maintains and uses information related to the products it sells, with the aim of improving their quality, design and maintenance, always complying with our legal obligations.
The only personal data stored include the information strictly necessary to unequivocally associate the user with the products and services contracted. This data is also necessary to offer the corresponding updates, as well as the correction and performance improvement of our applications. In addition, we store personal data that you have provided through the FERMAX website or during your interactions with FERMAX commercial and technical representatives.
The personal data we collect depends on the nature of your interaction with us or the services you use, but may include the following:
Data that you provide directly to us
Contact information and preferences: name, surname, address, telephone number, e-mail address, and preferred language for receiving commercial and product communications. If you explicitly state so, we store your preferences and interests in our products and services, as well as how you prefer to receive our information. We also store, conveniently anonymised, responses to customer satisfaction surveys, or additional information you have provided to us in order to facilitate the provision of FERMAX services and better respond to our customers' inquiries.
Account data: collected in case of acquisition or registration in FERMAX services, and include registration history, billing and technical support.
Location data: if you use FERMAX Internet-connected devices and associated services that require location to optimise service (e.g., call forwarding), we need to collect general geolocation data, including: IP address, city, and country. We also store location data (country, city and full address) if you choose to provide such information when you register on our website.
Security credential data: we store your username, password hash, and secret questions/answers needed for user authentication and forgotten password recovery.
Payment data: we store the data necessary to process payments and prevent fraud. This information includes: credit/debit card numbers, security code numbers, and other information related to the billing process.
Web and social network data: we store anonymised information about visits and browsing activity on FERMAX websites, including the content visited, the medium of origin of the web visit and other clickstream behaviours such as links clicked on. There are also social networking features that allow you to share FERMAX information on your social networks. The use of these functions may result in the collection or exchange of information about you, depending on the function. We encourage you to review the privacy policies and settings of the social networks you use, and to make sure you understand the information those sites collect, use, and share.
Data of our devices and services in case the user explicitly accepts it, the following information will be stored to assist in the improvement of those products and services:
- Device Data: We obtain information from your video door phone device such as the firmware version, model, region, date the device was manufactured, date the device was first connected, age of the device, warranty status, unique device identifiers, and other technical information that varies by product.
- Product usage data: we obtain the video door entry system usage data.
- App Data: We obtain information related to FERMAX mobile applications, such as mobile operating system version, location, language, app software versions, and update information.
- Performance Data: We obtain information related to the performance of certain hardware components, firmware, software and applications. Some examples of the data we obtain are information related to memory and processor performance, environmental conditions and system failures, event logs and other technical information that varies depending on the device.
The user is not obliged to share the personal data we request. However, if you choose not to do so, we may not be able to offer you some of FERMAX's services, certain specialised functions, or we may not be able to respond effectively to some of your inquiries.
HOW DO WE USE THE DATA?
We collect and use personal data to optimise our customer relationship and to be able to offer you a better service experience through analytics, diagnostics and the use of conveniently anonymised information. Some examples of the use of this data are: the possibility of offering comprehensive assistance; facilitating returns and repairs; improving the performance and operation of our products; and warning of firmware and software security updates, in order to ensure optimal operation of the device or service.
Finally, in the event that the user explicitly accepts this, your contact details will be used to send you administrative communications and promotional offers, always in compliance with current legislation.
HOW DO WE MAINTAIN DATA SECURITY?
To prevent unauthorised access and disclosure of data, and to ensure the correct use of information, we use all technical means at our disposal and have defined appropriate physical, technical and administrative procedures to protect the data we collect and process.
FERMAX retains data as required or permitted by law, and as long as the data continues to have a legitimate business purpose. If critical information is required (such as login and user password) we use additional security technologies and procedures, protecting such information and communications by encrypting with the latest versions of the TLS transport layer security protocol or using X.509 certificates.
HOW DO WE SHARE DATA?
We do not sell, trade or actively share personal data with third parties. However, FERMAX technology relies on third party platforms and technologies for the storage and/or processing of this data. These third parties have their own information security and privacy policy, in strict compliance with the GDPR, with which FERMAX delegates all responsibility for unauthorised access to data on the following platforms:
- Apple App Store or Google Play, where FERMAX distributes its mobile applications.
- Microsoft's Azure Platform, where FERMAX hosts the Web services dedicated to our products connected to the Internet.
- Zoho Campaigns for sending mail.
- Google Analytics for web traffic analysis.
FERMAX, as Data Controller, undertakes to choose third parties (Data Processors) that offer sufficient guarantees to apply adequate technical and security measures, so that the processing complies with the GDPR and guarantees the protection of the rights of the interested parties.
By accepting this privacy policy, you agree that your information may be transferred to these data processors in accordance with their respective privacy policies.
CONSENT WHAT ARE THE RIGHTS OF THE USER WITH REGARD TO HIS/HER DATA?
By registering and/or activating the use of FERMAX services, the user consents to this Privacy Policy.
The Data Controller wishes to inform that users may exercise their rights of access, rectification, cancellation, opposition, limitation of data processing and data portability by any of the following means:
- Directing a written communication, together with a photocopy of the user’s National Identity Document or other legally valid means of proving the user's identity, to the following address: Fermax, in Valencia - Spain, Avenida Tres Cruces, 133. This communication should include the following information:
- Name and surname(s) of the user.
- Detailed description of the request.
- Address for notification purposes, date and user signature.
- Documents supporting the request made, if applicable.
- Users may also contact the following address privacidad@fermax.com Communication to this address must be sent from the account registered in our files. Such communication should contain the same information as that indicated in the preceding paragraph.
In addition, FERMAX may ask you to prove your identity or require more information in order to process your request with guarantees that you are the applicant.
In addition, in order to solve any doubt related to the treatment of the data coming from the products and services of FERMAX, or with respect to our privacy policy, the user can also do so by contacting the person in charge of the treatment or the Data Protection Delegate through the mail privacidad@fermax.comor by sending a written communication to the address Avenida Tres Cruces 133, Valencia, Spain.
CHANGES TO OUR PRIVACY STATEMENT
If we change our privacy statement, we will post the revised statement here, along with the updated revision date. In the event of significant changes to our privacy statement that materially alter our privacy practices, we will notify you by all means of contact, including: e-mail; notices on our corporate websites; postings on our social networks; and updates on our apps.
